Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Mobo Technology LLC ("we," "us," or "our"), governing your use of the SpeakDaily mobile and web application (the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
SpeakDaily is an AI-powered English speaking practice application that provides voice-based conversational coaching, session scoring, and language progress tracking. The Service is available on iOS, Android, and web platforms.
3. Eligibility
You must be at least 13 years of age to use SpeakDaily. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If we discover that a user is under 13, we will promptly delete their account and data.
4. Account Registration
To access core features, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Keep your account credentials confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
We support registration via Google Sign-In. Your use of third-party sign-in services is also subject to those providers' terms.
5. Subscriptions & Billing
SpeakDaily offers free and premium subscription tiers. Premium access is available through auto-renewing subscriptions:
- Weekly plan — billed every 7 days
- Monthly plan — billed every 30 days
Subscriptions are processed through the Apple App Store or Google Play Store. All billing, refunds, and subscription management are governed by your platform's store policies. To cancel, manage your subscription through your device's store settings before the renewal date.
We reserve the right to change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.
6. Free Trial
We may offer a free trial period for new users. At the end of the trial, your subscription will automatically convert to a paid plan unless cancelled before the trial ends. Trial eligibility is determined at our discretion and may be limited to one per user.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Use automated tools, bots, or scripts to access or scrape the Service
- Impersonate any person or entity
- Transmit any content that is harmful, abusive, obscene, or otherwise objectionable
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Service
8. Intellectual Property
The Service and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, audio, and software — are the exclusive property of Mobo Technology LLC or its licensors and are protected by applicable intellectual property laws.
You retain ownership of any voice recordings or content you provide. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide and improve the Service, as described in our Privacy Policy.
9. Third-Party Services
The Service integrates with third-party providers including authentication services, cloud infrastructure, analytics platforms, and AI processing services. Your use of the Service is subject to those providers' terms and privacy policies. We are not responsible for the practices of third-party services.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MOBO TECHNOLOGY LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. SpeakDaily is a practice tool and does not guarantee specific language learning outcomes.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOBO TECHNOLOGY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Termination
We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately. See our Data Deletion Policy for what happens to your data.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us at support@mobotechnology.com.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you through the app or by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
